Terms and Conditions of Sale and Service

1. Purpose

These General Terms and Conditions of Sale (GTC) govern the contractual relationship between Colours of Madagascar / www.colours-of-madagascar.com, hereinafter referred to as “the Organizer”, and any person making a booking for an excursion, tour, or tourist service via the website www.colours-of-madagascar.com or directly with Colours of Madagascar, hereinafter referred to as “the Client”.

By making a booking, the Client acknowledges having read and unconditionally accepted these GTC.

2. Services Provided

The Organizer offers excursions, tours, and tourist stays, in accordance with the descriptions published on the website.

Each service includes only the elements explicitly mentioned (transportation, guidance, meals, accommodation, etc.) and excludes any personal expenses or any services not specified.

3. Booking

Bookings can be made directly online via the website or through any other available means of communication (email, telephone).
A booking is considered confirmed upon receipt of written confirmation (confirmation email) and after full or partial payment, in accordance with the conditions defined in Article 4.

4. Prices and Payment Terms

The prices indicated on the website are expressed in euros, all taxes included.
A deposit of 30% is required at the time of booking. The balance must be paid no later than the day of the excursion.
In the case of last-minute bookings, full payment may be required immediately.

Accepted payment methods:

Advance payment: credit card (Visa, Mastercard) or PayPal, bank transfer.
On site: cash payment only.

5. Cancellation and Refund Policy

Cancellation by the Client:

– More than 30 days before the service: full refund of the deposit.
– Between 3 and 5 days before the service: 30% of the total amount will be withheld.
– Less than 2 days before the service: no refund will be granted.

Cancellation by the Organizer:

The Organizer reserves the right to cancel a service for safety reasons or in case of unfavorable weather conditions. In such cases, a new date will be offered to the Client or a full refund will be issued.

6. Responsibilities and Liability

The Organizer takes all necessary measures to ensure the proper execution of the services. However, it cannot be held responsible for:

– delays or changes due to external circumstances (weather conditions, traffic, strikes, etc.).
– loss, theft, or damage of the Client’s personal belongings.
– incidents occurring in case of negligence or failure to follow safety instructions.

The Client agrees to comply with safety rules and the instructions given by the guide or accompanying staff.

7. Insurance

It is strongly recommended that the Client take out travel insurance covering cancellation, medical assistance, and any potential expenses abroad.

8. Personal Data

The personal data collected during the booking process are used solely for managing the reserved services and are never shared with third parties without the Client’s consent. In accordance with the General Data Protection Regulation (GDPR), the Client has the right to access, correct, and delete their personal data.

9. Governing Law and Jurisdiction

These General Terms and Conditions of Sale are governed by Malagasy law. In the event of a dispute, the competent courts shall be those of the location of the Organizer’s headquarters, unless otherwise required by law.
